Medical malpractice occurs when a patient suffers unnecessary injury or death as a result of a negligent or incompetent action by a medical professional. A simple mistake by a health care professional is not enough to warrant the malpractice label. Some examples of actions, or failure to act, that constitute medical malpractice include: failure to diagnose, or misdiagnosis of, a disease; failure to provide medically appropriate treatment for a disease; unreasonable delay in treating a diagnosed disease; surgical error; incorrectly prescription of medication; and failure to obtain a patient's informed consent to a medical procedure.
